Eight More File Lawsuit Over Avandia

A group of eight Texans filed suit against the maker of Avandia, the diabetes drug, adding to the growing list of lawsuits over the drug and its maker.

The suit alleges GlaxoSmithKline's Avandia caused heart problems, among other issues. Avandia, which is part of a group of drugs described as thiazolidinediones that lower blood sugar by decreasing insulin resistance, has been under attack since a 2007 label on the product contains a warning over possible heart attacks. The warning was reportedly added after a study was made showing that patients taking Avandia had a 40 percent increase in the risk of cardiovascular disease. And the USDA has determined its heart risks outweighed its benefits.

The Texas lawsuit alleges Avandia is a defective product which puts patients at a high a risk for suffering heart attacks and accuses Glaxo of negligence, fraud, unjust enrichment, violation of Deceptive Trade Practices Act and gross negligence.

The Texas plaintiffs are seeking a refund for all the medicine they purchased, plus compensation for pain, mental suffering, physical impairment, and current and future medical expenses, among other damages.

Diabetes patient have enough risks without adding to the risk by lack of proper testing on drugs. Patients know some of the risks. But adding to those risks by individual negligence or under-testing increases the danger tremendously.
